Algemene voorwaarden locatieverhuur

Watersportvereniging De Breek · Landsmeer · KVK 40532073 · versie juni 2026

1. Definities

  1. WSV De Breek: Watersportvereniging De Breek, gevestigd in Landsmeer.
  2. Locatie: het terrein, de steiger en het clubhuis van WSV De Breek.
  3. Productie: de natuurlijke of rechtspersoon die de locatie huurt voor film-, foto- of reclame-opnamen.
  4. Dagdeel: een aaneengesloten periode van maximaal vier uur.

2. Reservering en bevestiging

  1. Een aanvraag wordt gedaan via het formulier op deze website of per mail aan bestuur@wsvdebreek.nl.
  2. De boeking is pas definitief na schriftelijke bevestiging door het bestuur en na ontvangst van de aanbetaling.
  3. WSV De Breek kan een aanvraag zonder opgave van reden weigeren, bijvoorbeeld als deze samenvalt met verenigingsactiviteiten.

3. Tarieven en betaling

  1. Tarieven worden per offerte vastgelegd. WSV De Breek is een sportvereniging en niet btw-plichtig — er wordt geen btw in rekening gebracht.
  2. Bij bevestiging wordt 50% van het bedrag in rekening gebracht; het restant uiterlijk zeven dagen voor de opnamedag.
  3. Betaling vindt plaats op het rekeningnummer van WSV De Breek zoals vermeld op de factuur.

4. Annulering

  1. Bij annulering meer dan veertien dagen voor de opnamedag: 25% van het overeengekomen bedrag.
  2. Bij annulering tussen zeven en veertien dagen voor de opnamedag: 50%.
  3. Bij annulering binnen zeven dagen voor de opnamedag: 100%.
  4. Verplaatsing naar een andere datum in overleg en, indien mogelijk, zonder annuleringskosten.

5. Toegang en tijden

  1. Opnametijden worden vooraf afgesproken. Toegang buiten reguliere uren is mogelijk in overleg.
  2. Het bestuur kan een vertegenwoordiger van WSV ter plaatse vragen tijdens de opnamen.
  3. Voor werkzaamheden op of met boten op het water is begeleiding van WSV verplicht.

6. Gebruik en huisregels

  1. De productie respecteert de huisregels zoals gepubliceerd op deze website.
  2. Geen open vuur, vuurwerk of pyrotechniek zonder voorafgaande toestemming.
  3. Het natuurgebied Het Twiske wordt niet betreden buiten de aangegeven paden.
  4. Drone-opnamen zijn alleen toegestaan met geldige vergunning; aanvraag is verantwoordelijkheid van de productie.
  5. De locatie wordt achtergelaten in dezelfde staat als bij aanvang. Afval en materiaal worden meegenomen.

7. Schade

  1. De productie is aansprakelijk voor schade aan de locatie, het clubhuis, de inventaris, de steiger of vaartuigen die tijdens of als gevolg van de opnamen ontstaat.
  2. Schade wordt direct gemeld bij het bestuur en op kosten van de productie hersteld.

8. Verzekering en aansprakelijkheid

  1. De productie is verantwoordelijk voor eigen verzekering — minimaal een geldige aansprakelijkheidsverzekering (WA) voor bedrijven.
  2. WSV De Breek is niet aansprakelijk voor schade, diefstal, verlies of letsel aan personen of materiaal van de productie of door de productie ingeschakelde derden.
  3. De productie vrijwaart WSV De Breek voor aanspraken van derden voortvloeiend uit de opnamen.

9. Beeldrechten en publicatie

  1. De productie behoudt de rechten op het opgenomen beeldmateriaal.
  2. Naamsvermelding van de locatie is toegestaan en wordt op prijs gesteld.
  3. WSV De Breek mag, mits inhoudelijk passend, kort beeldfragment delen voor eigen promotie van locatieverhuur, in overleg met de productie.

10. Overmacht

  1. Bij overmacht (waaronder weersomstandigheden die de locatie onbruikbaar maken, calamiteiten of overheidsmaatregelen) wordt in onderling overleg gezocht naar verplaatsing zonder annuleringskosten.

11. Toepasselijk recht

  1. Op deze voorwaarden is Nederlands recht van toepassing.
  2. Geschillen worden voorgelegd aan de bevoegde rechter te Amsterdam.

1. Definitions

  1. WSV De Breek: Watersport club De Breek, based in Landsmeer, the Netherlands.
  2. Location: the grounds, jetty and clubhouse of WSV De Breek.
  3. Production: the natural or legal person renting the location for film, photo or advertising work.
  4. Half-day: a continuous period of up to four hours.

2. Booking and confirmation

  1. Requests are made through the booking form on this site or by email to bestuur@wsvdebreek.nl.
  2. A booking is only final after written confirmation by the board and receipt of the deposit.
  3. WSV De Breek may decline any request without stated reason, e.g. when it conflicts with club activities.

3. Rates and payment

  1. Rates are agreed per quote. WSV De Breek is a non-profit sports club and not VAT-registered; no VAT is charged on the invoice.
  2. 50% of the agreed amount is invoiced on confirmation; the remainder no later than seven days before the shoot date.
  3. Payment is made to the bank account of WSV De Breek as stated on the invoice.

4. Cancellation

  1. Cancellation more than fourteen days before the shoot: 25% of the agreed amount.
  2. Cancellation seven to fourteen days before the shoot: 50%.
  3. Cancellation within seven days of the shoot: 100%.
  4. Rescheduling to another date is possible on agreement and, where feasible, without cancellation costs.

5. Access and timing

  1. Shoot times are agreed in advance. Access outside regular hours is possible by arrangement.
  2. The board may request a WSV representative to be present during the shoot.
  3. Working on or with boats on the water requires WSV supervision.

6. Use and house rules

  1. The production respects the house rules as published on this site.
  2. No open fire, fireworks or pyrotechnics without prior consent.
  3. The Twiske nature reserve is not entered outside marked paths.
  4. Drone footage is only permitted with a valid permit; the application is the production's responsibility.
  5. The location is left in the same condition as at the start. All waste and equipment is removed.

7. Damage

  1. The production is liable for damage to the location, clubhouse, inventory, jetty or vessels arising during or from the shoot.
  2. Damage is reported to the board immediately and repaired at the production's cost.

8. Insurance and liability

  1. The production is responsible for its own insurance — at minimum valid business liability cover.
  2. WSV De Breek is not liable for damage, theft, loss or injury to persons or materials of the production or any third parties engaged by the production.
  3. The production indemnifies WSV De Breek against third-party claims arising from the shoot.

9. Image rights and publication

  1. The production retains the rights to the captured imagery.
  2. Crediting the location is permitted and appreciated.
  3. WSV De Breek may, where contextually appropriate, share a short clip for its own location-rental promotion, in agreement with the production.

10. Force majeure

  1. In case of force majeure (including weather rendering the location unusable, calamities or government measures), the parties will seek rescheduling without cancellation costs by mutual agreement.

11. Applicable law

  1. These terms are governed by Dutch law.
  2. Disputes are submitted to the competent court in Amsterdam.
